Borjas, et al v. Calvary Church – Court Denies Calvary’s Motion to Dismiss

Calvary Church Discrimination Lawsuit, Court Denies Motion to Dismiss

The families are grateful for Judge Caldwell’s order denying Defendants’ Motion to Dismiss on all four claims brought against Calvary Church. While the Court required several revisions to the Complaint, these were largely stylistic and did not impact the substance of the families’ claims.

The case now proceeds to discovery, where the families will now be armed with the law’s full complement of tools to help prove their allegations that Calvary Church has a pattern and practice of discriminating against disabled children and that they fraudulently concealed that practice from public view. Hopefully, this order will prompt Calvary Church to voluntarily bring its Child Development Center into compliance with North Carolina law.
